Scale Your Hotel operates on a high-resource, front-loaded architectural model. Please review our stringent cancellation and capital recovery directives below.
Our mandate is absolute strategic alignment and Net Operating Income (NOI) scalability. However, due to the irrecoverable nature of digital architecture, ad-spend deployment, and cinematic production, our refund parameters are strictly governed by the clauses below. Please audit this protocol prior to engaging our Growth Services.
1. Voluntary Cancellation Architecture
If the Client initiates a voluntary cessation of the Growth Protocol or exhibits a "change of mind" post-onboarding, Scale Your Hotel assumes zero liability for the termination of services. Should the Client request a provisional hold or operational freeze on the campaign architecture, the service timeline continues to depreciate.
Prior to authorizing any capital return, Scale Your Hotel reserves the unilateral right to exhaust all strategic efforts to finalize the deliverable. In the event of a premature termination by the Client, a Protocol Decommissioning Fee of 20% of the Total Contract Value (TCV), plus prorated human-capital expenditure (earned fee), plus any third-party infrastructure fees, will be immediately deducted from the balance.
2. Burden of Proof & Refund Eligibility
Capital recovery (refunds) will be sanctioned exclusively in scenarios where a comprehensive Internal Revenue Audit determines a systemic failure by Scale Your Hotel to deploy the baseline architectural deliverables.
To initiate a formal grievance, the Client must submit a petition to hello@scaleyourhotel.com. This petition must include statistically significant empirical data (minimum 90-day aggregate server-side logs and PMS reconciliation statements) definitively proving that the direct booking infrastructure failed due to gross negligence on our part, independent of market forces or external platform volatility.
3. The Sunk-Cost Doctrine (Non-Recoverable Assets)
Refunds are strictly voided once capital has been mobilized toward the execution of the Growth Protocol. Due to the high-velocity nature of our operations, the following components are deemed irreversibly consumed and 100% non-refundable:
- Intellectual property deployment and direct-booking strategic blueprinting.
- Cinematic content creation (drone videography, premium property photography, and post-production color grading).
- Capital disbursed to Meta Ads, Google Hotel Ads, or OTA sponsored-placement auctions.
- Governmental taxation, statutory filing fees, and third-party API gateway integration costs.
4. Algorithmic Volatility & Ungovernable Factors
Scale Your Hotel engineers premium visibility architectures; however, absolute yield predictability cannot be guaranteed. Our protocols are inherently dependent on the algorithmic infrastructures of third-party monopolies (e.g., Booking.com ranking matrices, MakeMyTrip visibility algorithms, Google Core Search Updates, and Meta ad-auction dynamics).
Fluctuations in RevPAR (Revenue Per Available Room) resulting from sudden OTA policy shifts, technical deprecations in third-party APIs, shadow-banning by listing platforms, or localized market demand collapses are unequivocally outside our jurisdiction. Negative ROI attributed to these ungovernable digital ecosystem factors voids any eligibility for capital recovery.
5. Force Majeure & Ecosystem Disruptions
Scale Your Hotel shall be fully indemnified and held harmless from any breach of our Satisfaction Guarantee, or delay in strategic execution, caused by a Force Majeure Event. This includes, but is not limited to: severe meteorological anomalies (earthquake, cyclone, flood), acts of God, global pandemics, internet backbone outages, systemic failures of AWS/Cloudflare infrastructures, cessation of OTA operations, civil unrest, war, or drastic legislative modifications governing the Indian/Global hospitality sector.

This Capital Verification & Refund Protocol is subject to immediate algorithmic and legal iteration without prior notification. Hotel partners are mandated to review this ledger periodically to ensure compliance with our operational baseline.
